(Happy) Dunn, defendant below, was charged by information in the district court of Cotton county, Oklahoma, with the commission of the crime of burglary in the second degree, Title 21 O.S. 1951 Â§ 1435 [21-1435], in Temple, Oklahoma, on March 16, 1951. The case was tried to a jury; defendant found guilty; his punishment fixed at 3 years in the State Penitentiary; and judgment and sentence entered accordingly, from which this appeal has been perfected.
